The exhibition ba [does not equal to] b+a explores the question of how a museum's activities--its mechanisms, modes of operation, and logics--are reflected in the works in its collection. On the occasion of MUSA's tenth anniversary, the museum's program of exhibitions and publications takes a self-reflective turn, shedding light on the specific characteristics of Vienna's municipal art collection, whose origins go back to the 1950s, and raising far-reaching questions concerning the museum as an institution. The assumption underlying the exhibition is (...) that the objects in a museum's collection are crucial to its character. They may seem to be innumerable separate pieces--but the museum is more than their mere juxtaposition. "That which is composed of something in such a way that the whole is a unity," Aristotle writes, "is a unity not as an aggregate is a unity, but as a syllable is. The syllable is not the letters, nor is BA the same as B and A; nor is flesh fire and earth." It is only in the interweaving of the individual components, in their layering and inexhaustible potential constellations, that they engender the necessary density that lets us understand, and interact with, the museum as a living archive. In this article we provide an intrinsic characterization of the famous Howard–Bachmann ordinal in terms of a natural well-partial-ordering by showing that this ordinal can be realized as a maximal order type of a class of generalized trees with respect to a homeomorphic embeddability relation. We use our calculations to draw some conclusions about some corresponding subsystems of second order arithmetic. All these subsystems deal with versions of light-face Π11\documentclass[12pt]{minimal} \usepackage{amsmath} \usepackage{wasysym} \usepackage{amsfonts} \usepackage{amssymb} \usepackage{amsbsy} \usepackage{mathrsfs} \usepackage{upgreek} \setlength{\oddsidemargin}{-69pt} \begin{document}$$\varPi ^1_1$$\end{document}-comprehension.

In this article we characterize a countable ordinal known as the big Veblen number in terms of natural well-partially ordered tree-like structures. To this end, we consider generalized trees where the immediate subtrees are grouped in pairs with address-like objects. Motivated by natural ordering properties, extracted from the standard notations for the big Veblen number, we investigate different choices for embeddability relations on the generalized trees. We observe that for addresses using one finite sequence only, the embeddability coincides with the (...) classical tree-embeddability, but in this article we are interested in more general situations. We prove that the maximal order type of some of these new embeddability relations hit precisely the big Veblen ordinal ϑΩΩ\documentclass[12pt]{minimal} \usepackage{amsmath} \usepackage{wasysym} \usepackage{amsfonts} \usepackage{amssymb} \usepackage{amsbsy} \usepackage{mathrsfs} \usepackage{upgreek} \setlength{\oddsidemargin}{-69pt} \begin{document}$${\vartheta \Omega^{\Omega}}$$\end{document}. Is the law good? How can it be improved? These questions are frequently addressed, both in traditional doctrinal research and in interdisciplinary legal research. In this article, I elaborate a general argumentative framework for justifying evaluations and recommendations for legislative reform, and I identify the chains of argument for making evaluations and recommendations. This may help researchers to make their arguments explicit and transparent, and then to justify the choices made for each of the steps in the argument. This enables (...) readers - as well as authors - to assess whether the argument’s conclusions are sound and convincing. A key problem in making these arguments concerns the choice of standards for evaluation. I suggest that they can be best understood in terms of the underlying values. In order to make all-things-considered evaluations and normative recommendations, interdisciplinary cooperation between doctrinal, socio-legal, and legal-philosophical researchers is necessary. Therefore, individual researchers will usually have to settle for pro tanto evaluations and recommendations. (shrink)

Concepts such as law, religion or morality may refer both to a practice (or process) and to a doctrine (or product). My thesis is that we should not regard these as separate phenomena, but as two partly incompatible models of the same phenomenon. Law, religion and morality are therefore essentially ambiguous concepts (EAC). An EAC is a concept which refers to a dynamic phenomenon that may only be described and modeled in at least two different ways that are each essentially (...) incomplete and which are partly incompatible with each other. This means that we have to choose between either an incomplete description or an incoherent one. An EAC resembles an essentially contested concept (ECC) as both allow of conflicting conceptions. However, for an ECC the explanation of pluralism lies in the evaluative character of the concept, for an EAC it lies in the dynamic character of the phenomenon. The insight that many of our social concepts are essentially ambiguous may provide a better understanding of social and customary rules and of the debate between legal positivism and its opponents. I reconstruct the positions of three contributors to this debate, Fuller, Hart and Dworkin. An EAC framework offers a better insight into their theories, highlights the deficiencies, and explains why their debates were characterized by serious misunderstandings. (shrink)

This article looks at the evidence for a turbulent episode in the life of the Jewish community at Elephantine. In the months leading up to the destruction of the Yaho temple, the summer of 410 BCE, Jews and Egyptians found themselves at loggerheads in a conflict about a precious stone. The stone had been stolen from the Egyptians and then turned up in the hands of Jewish traders. Six letters from the Elephantine archives document the affair. Their analysis leads to (...) the reconstruction of a crucial period in the relations between Persians, Jews, and Egyptians in the late Achaemenid era. (shrink)

The article aims to clarify Kant's concept of law, which he developed in the “Metaphysische Anfangsgründe der Rechtslehre” from 1797. Decisive for Kant's concept of law is the distinction between internal and external relations of persons. Law is restricted to external relations. So the crucial question is: Where does Kant draw the line between internal and external relations? Four possibilities are analysed in an order of increasing extent: only causal consequences of our actions in the external world beyond our bodies; (...) causal consequences in the external world plus our externally empirical sensible bodily behaviour; causal consequences in the external world plus all physiological changes in the actor like nerve stimulations and brain activities; all features of plus all non-a-priori mental and emotional changes like emotions, inclinations, empirical concepts, hypothetical imperatives etc., in sum: Kant's division between homo noumenon and homo phaenomenon. While modern interpretations would perhaps endorse possibility, Kant has chosen – so the main argument of the article – the widest possible alternative. This brings him to a very extensive concept of law. Only in reflecting this wide extent of Kant's concept of law, we are able to understand his philosophy of law. (shrink)

Modern legal theory is in its mainstream characterized by two fundamental reductionisms. Law is no longer understood with reference to necessary aims like justice, self-preservation, or freedom, but only to contingent means. And the plurality of possible means and elements of law is reduced to norms, rules, and/or principles, therebyneglecting, or at least downsizing, other alternatives like concepts, institutes or institutions. This contribution will confront the second reductionism. This confrontation results in the thesis that concepts play a major role in (...) law, an even greater role than norms. In this article it will be tried to elucidate the role of concepts in law in five steps. First it will be asked what concepts are. Second the appropriate method for conceptual analysis will be analyzed. Third it will be questioned how concepts are related to each other in a conceptual scheme in general. Fourth this understanding of a conceptual scheme in general will be transferred to the conceptual scheme of the law. Fifth in a sort of meta-reflection it will be inquired if concepts or norms are prior in the law. (shrink)

The article aims to understand the phenomenon of law/the concept of law from a philosophical perspective. First, it is argued that law is a sort of human action. Therefore, the phenomenon of law can only be understood by analyzing the two main elements of human actions: aims and means. The aim of law is the mediation between possible contrary, conflicting concerns. The four parts of this aim are analyzed. But also morals and other social norms have a similar aim. So (...) law has to be distinguished from morals and these other social norms by its specific means. The specific means of law are its categorical character, its externality, its formality and - if law and religion are separated like in many modern societies - its immanence. (shrink)

In this article we investigate whether the following conjecture is true or not: does the addition-free theta functions form a canonical notation system for the linear versions of Friedman’s well-partial-orders with the so-called gap-condition over a finite set of n labels. Rather surprisingly, we can show this is the case for two labels, but not for more than two labels. The DGBA project seeks to digitize the entire backlist of titles published since 1749 to ensure that future generations have digital access to the high-quality primary sources that De Gruyter has published over the centuries.

A positive correlation between religious participation and subjective well-being has been demonstrated frequently in empirical research among Christian believers. In this article, we demonstrate that this relationship also exists in a Muslim religious context. Data are presented, collected from a sample of Muslim youngsters of Turkish and Moroccan origin, now living in The Netherlands. Analysis of variance showed that young Muslim migrants who carry out religious duties, have a better subjective well-being than those who are less religiously involved, although this (...) is more the case with men than with women. A qualitative analysis of the interview protocols revealed that female migrants suffer more from the restrictions laid upon them by religious obligations. It revealed also that the underlying factor of the relationship between religion and subjective well-being is group cohesion. Religious observance strengthens a feeling of togetherness and collective identity. (shrink)

The aim of this study was to assess the links between religious discrimination and developmental and contextual variables. Based on the assumption that discrimination results from the interplay of prejudice and moral thinking, discriminatory behaviour was hypothesised to be linked to age, school environment, minority or majority group membership, and parental religious socialisation practices. The results indicate that discrimination is more frequent during childhood than during pre-adolescence or adolescence, more common in homogeneous schools than in heterogeneous schools, and more likely (...) when parents frequently express messages promoting mistrust of other religious groups. Participants from the minority group were more likely to discriminate against their own ingroup than were those from the majority group. Further studies are needed to determine whether these links are correlative or predictive, and to understand the underlying processes of religious discrimination. (shrink)

This article addresses the research question: “How do Dutch highly educated Muslim women of Moroccan descent use prayer in dealing with problems?” The theoretical framework was mainly based on the work of Pargament et al. regarding religious coping. The empirical part of the study consisted of a quantitative and a qualitative part. This article presents results of the quantitative part. For the quantitative part of our research, 177 questionnaires were collected using snowball sampling. We asked respondents about their praying practices (...) and their ways of religious coping, using the Brief RCOPE. The connection and communication in their prayer with a loving, caring, benevolent God is the main religious way in which these Muslim women of Moroccan descent cope with all kinds of problems. This use of prayer as a way of coping can be clarified through the psychological functions of religiosity and prayer that are suggested by Pargament, Koenig, and Perez. Prayer could help them in: finding meaning, being master over their circumstances and controlling their emotions, finding comfort and closeness to God, experiencing intimacy with others and closeness to God, and transforming their way of life. We did find few negative religious coping strategies, such as negative feelings towards God or alienation. This is in line with research results of Abu Raiya and Pargament. As Islam implies surrender to God, it may be difficult for Muslims to admit their religious distress, doubts, and struggles. (shrink)

A quasi-order Q induces two natural quasi-orders on $${\mathcal{P}(Q)}$$, but if Q is a well-quasi-order, then these quasi-orders need not necessarily be well-quasi-orders. Nevertheless, Goubault-Larrecq (Proceedings of the 22nd Annual IEEE Symposium 4 on Logic in Computer Science (LICS’07), pp. 453–462, 2007) showed that moving from a well-quasi-order Q to the quasi-orders on $${\mathcal{P}(Q)}$$ preserves well-quasi-orderedness in a topological sense. Specifically, Goubault-Larrecq proved that the upper topologies of the induced quasi-orders on $${\mathcal{P}(Q)}$$ are Noetherian, which means that they contain no (...) infinite strictly descending sequences of closed sets. We analyze various theorems of the form “if Q is a well-quasi-order then a certain topology on (a subset of) $${\mathcal{P}(Q)}$$ is Noetherian” in the style of reverse mathematics, proving that these theorems are equivalent to ACA 0 over RCA 0. To state these theorems in RCA 0 we introduce a new framework for dealing with second-countable topological spaces. (shrink)
